ADA COUNTY IDAHO UNFAIR TO WIDOW

May 2007

Unsanitary and unsafe conditions creating fire hazard

Do not plan to live in Ada County Idaho if you expect to live in a clean peaceful environment.  Zoning laws in Ada County allow neighborhood junk yard to grow in county subdivisions.

Welcome!

As of 8:56 AM, Ada County Idaho Zoning Enforcement, under the leadership of Mr. Richard Cook, has declared this property "in compliance".  The tenant will be allowed to keep his dismantled Mustangs and the old wooden camper will be allowed to remain at the property line.  The multiple tires will be allowed to remain at the fence line.  The car parts will be allowed to remain strewn across the yard.  In other words, Mr. Richard  Cook, by his inaction of initiating zoning enforcement protection ordinances, allows junk yards in neighborhood subdivisions in Ada County.

On Wednesday, March 14th, I contacted the Ada County Fire District and left a message with Tom Gainer, the fire inspector for this district.  He returned my call at 9:40 AM today.  He works for the Boise Fire Department and is under contract with Ada County to do fire inspections.  However, they have no authority to enter the property and inspect it or to enforce clean up.

This morning, the county zoning officer who has been working on these properties in GoldenDawn called to issue the message that the property is in compliance.

Today, I hold liable for the health and safety the following people:

Mr. Richard Cook, Ada County Planning and
     Zoning Director
     Ada County Commissioners
     Ada County Community Development
David Buchanan, owner of 3600 Jesmond
Thomas Buchanan, tenant of 3600 Jesmond

Has your neighbor’s junk got you down?

Tired of the odor that wafts across the fence?

Choking on the unpleasant fumes?

Can’t see the sunrise because of the flies?

Don’t suffer in silence.  Take charge of the cleanup.

As I gazed out my dining room window on the wonders of the neighborhood junk yard, I pondered the idea of hiding the accumulation of junk.

Then it hit me.  Why should I have to pay to cover up the mess? Putting up siding on the carport will block a direct source of light for my daughter's bedroom and the dining room.

As a citizen, I have the right to enjoy my property without the smells and views of someone else's junk.

The junk yard over my back fence is a public health, fire and safety hazard.

What's New?

February 28, 2007, Response from Mr. Richard Cook, Ada County Planning and Zoning Administrator, Ada County Idaho

Dear Mrs. Dowd:

I have been informed that one more vehicle has been removed from the subject property. My enforcement staff is out of the area for training and will not be back in the office until Monday, March 5th. When they return Tammy Emmons will check the property one more time to verify that this additional vehicle has been removed. If this is in fact the case, then the property will be in compliance with Ada County Code and no further action will be taken regarding this property unless there are future violations.

I understand that you may not agree with the provisions of the Ada County Code but it is the code that we must use and we cannot go beyond it.

Sincerely,
Richard Cook
Ada County Planning & Zoning Administrator

When I met with members of the zoning department on February 9, 2007, I was assured the file on the 3600 Jesmond property would be turned over to the prosecutor's office no later than February 26, 2007.  The zoning officers had indicated they would be out of the office on the 27th and 28th, but was told by zoning enforcement officer that she would send the file to the prosecutor's office before she left town.  When I was told this would be filed on the 26th, I asked if that was a bankable statement.  It is a good thing this promise wasn't a check...it would have bounced.

At the February 9, 2007, meeting, I was told the county clean-up crew from the jail trustees had been declined by the property owner.  The Boys Scouts cleaning it up was a possibility, and I was told someone from the Boys Scouts had called the zoning office to find out what the clean-up would entail.  So far, no clean-up crew from any source.

A conversation with Monica at the prosecutor's office on February 27, 2007, indicated their office does not have the file.

One of the dismantled Mustangs has now been pulled closer to the street.

Ada County needs to update ordinances to assure neighbors of county subdivisions that they do not have to tolerate this type of junk.  Allowing 4 months for an "evidence file" to compile is unacceptable.  The evidence has been there and has not moved.

As I have told the county on multiple occasions, I am a widow on a limited income.  I do not have the funds to block off the sight and smells of the house next door.

A positive response from the county that indicates when the county will come to clean up the property will be appreciated.

Sincerely Yours,

Pamela G. Dowd

Does this look like compliance to you?
